1. About the Service

Sail is an AI-assisted will-writing service operated by Probate Tech Ltd (Company No. 12571623), registered in England and Wales. Our service uses artificial intelligence to guide you through the process of creating a will document.

2. Not Legal Advice

Sail does not provide legal advice. Our service is an AI-assisted tool that helps you create a will document based on the information you provide. We are not a law firm, and the use of our service does not create a solicitor-client relationship.

If you have complex estate planning needs, disputes, or concerns about the legal validity of your will, we strongly recommend consulting a qualified solicitor.

3. Legal Validity of Your Will

For your will to be legally valid under the Wills Act 1837 (as amended), it must be:

  • In writing and printed on paper
  • Signed by you (the testator) in the presence of two witnesses
  • Signed by both witnesses in your presence (witnesses must not be beneficiaries or spouses/civil partners of beneficiaries)

The document generated by Sail is not legally valid until properly signed and witnessed. It is your responsibility to ensure the will is executed correctly.

4. Your Responsibilities

By using Sail, you agree that:

  • You are at least 18 years old and have the mental capacity to make a will
  • The information you provide is accurate and complete to the best of your knowledge
  • You will review your generated will carefully before signing
  • You are responsible for properly signing and witnessing the will as described in Section 3
  • You will store your signed will in a safe and accessible place and inform your executors of its location
  • You will update your will when your circumstances change (marriage, divorce, birth of children, significant changes in assets)

5. Executors

If you appoint Probate Tech Ltd (or any associated entity) as an executor of your will, please note that executor services are subject to separate terms and fees. Executor fees will be clearly disclosed and agreed before any appointment takes effect.

You are under no obligation to appoint us as executor, and our will-writing service can be used regardless of your choice of executor.

6. Service Availability

We aim to keep Sail available at all times, but we do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or other operational reasons. We will endeavour to provide notice of planned outages where possible.

7. Limitation of Liability

To the maximum extent permitted by law, Probate Tech Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

We do not accept liability for any loss or damage arising from a will that has not been properly signed and witnessed, or from inaccurate information provided by you.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

8. Intellectual Property

The content of your will belongs to you. The Sail platform, including its software, design, and branding, is the intellectual property of Probate Tech Ltd. You may not reproduce, distribute, or create derivative works from the platform without our written permission.

9. Termination

You may stop using Sail at any time. We reserve the right to suspend or terminate your access if you breach these terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of any material changes by email or through the service. Your continued use of Sail after changes are posted constitutes acceptance of the updated terms.
